Ritter’s Rant 068: The Battle of New York

The US Constitution is under attack by the Trump administration. Nicolas Maduro’s jurisdiction hearing in New York is the last chance to demonstrate that the rule of law matters.

Transkripzioa:

Hello and welcome to this edition of Ritter’s Rant. Today, we’re going to be talking about the Battle of New York. Now, I’m not talking about going back in time and to the American Revolution, although many of the ideas that will be discussed in this rant are revolutionary and do, in fact,

date from the time of the birth of our constitutional republic. But I’m talking about the battle that’s being waged today in a courtroom in Manhattan. the courtroom of a district judge named Alvin Hellerstein. He sits on the bench of the Southern District of New York and Hellerstein is currently overseeing the trial

or at least preparatory arguments in anticipation of a trial of Nicolas Maduro and his wife, who were illegally abducted by American Special Operations Forces earlier this week. Alvin Hellerstein is 92 years old. He’s been around for a while. I think in 1989, he was appointed to the bench by Bill Clinton. Interesting character.

He’s been overseeing the Maduro case since the 2020 indictment. He’s the one who set forth the indictment, heard the grand jury argument, and he’s the guy who created the paperwork that… created the justification that was used by the Trump administration to take Maduro into custody. But, you know,

the indictment doesn’t give carte blanche for the United States to forego constitutional due process. And Hellerstein is on record in the past. Just last year, he opposed a Trump administration decision to deport a Venezuelan illegal immigrants, citing that they had been denied their due process. So legal processes do matter.

And so this will be interesting to see what Hellerstein does at this juncture. He’s not in the business of hearing arguments. He took the plea, a not guilty plea from maduro and his wife and has set the next court date to be march 16th and i think we

can see by the delay between um court dates that this is going to be a long drawn out affair as american justice normally is now why am i calling this the battle of new york with plain and simple what’s happening here today isn’t just a um an assault on, you know, the rule of law.

It’s an assault on the very fabric of the identity of the United States of America. We have a situation where the sitting president United States and absolute disregard for both the Constitution and international law has taken into custody the sovereign leader of a sovereign state. This is a straight up violation. of the charter of the United Nations.

Now people will say, well, what does the United Nations matter? Marco Rubio, our Secretary of State, certainly doesn’t believe that the United Nations matters, but it does. You see, when we look into the Constitution of the United States, we note that the President of the United States has the authority to enter into

treaties and that when these treaties are ratified by two-thirds of the United States Senate, they take on the effect of law. subsequent decisions by the Supreme Court of the United States, one in, I believe, 1824, the other in 1886 or so, basically say that treaties are the supreme law of the land.

When we enter into a treaty relationship, the president signs a document and the Senate ratifies it, it becomes the law of the land constitutionally enforceable. And so when we have Marco Rubio and Donald Trump and others saying that international law doesn’t matter, when we have American citizens say international law doesn’t matter, what you’re saying is the U.S.

Constitution doesn’t matter. The rule of law doesn’t matter. and now we have a problem because this is a constitutional republic and the only legitimacy it has as a sovereign nation is its constitution so the moment you say the constitution doesn’t matter is the moment you say that the united states of

america no longer exists as a constitutional republic and this is the problem significant number of americans seem to believe that this government this president is above the law he can do anything he wants the constitution is an impediment you know it’s not you know ironclad law it’s it’s an obstacle that needs to be

navigated around uh this is extremely problematic now the constitution uh you know has putting protections against presidents going out of control. You know, we have a system of government that has checks and balances, three separate but equal branches of government. So here we have an executive, it’s clearly off the rails,

doing whatever it wants in total violation of international law and total abrogation of its constitutional duties and responsibilities. But we have a Congress that should be able to step in and do something, but they’re not. Congress is asleep at the wheel. Congress has totally allowed itself to be castrated when it comes to war powers,

allowing this president to do anything he wants and not doing anything to hold him to account. And Congress is silent on the issue of treaties. You see, again, not to get too much into the weeds here, but when we sign a treaty, it is the law of the land.

Now, the president could decide that the United States doesn’t want to adhere to a treaty. He does this through bilateral negotiations or discussions with the nations involved. And if it comes down to it, nations can find one another in breach of treaty obligations. And this can lead to war. War.

that’s not what’s happening here the president just ignored it the nation that at stake is too weak to do anything about it and now he’s taken a leader to court to court but he the court has no jurisdiction you see the treaty is the law and unless congress enacts legislation that modifies, repeals,

or otherwise puts conditions on this treaty law, the law is the supreme law of the land and the United Nations Charter prohibits the United States from going forth and seizing Nicolas Maduro, the legitimate president of Venezuela, and bringing him to the United States. We have no jurisdiction over this matter. No court can see this case.

No court can see this case. Because Congress has taken no action to modify the United Nations Charter in a manner that allows Trump to do this. So now it comes down to the court. You see, two branches of government, the legislative and the executive, have punted on their responsibilities, their constitutional duties and obligations.

And it comes down to a 92-year-old district judge, Alvin Hellerstein, to decide whether or not this constitutional republic will survive, because I’m here to tell you right now, if this president, who has three more years to serve, gets away from with this absolute violation of the law of the constitution if the executive branch

can act as a dictatorship with no checks and balances from either the legislative branch or the judicial branch then this is over for america we may call ourselves the united states of america the flag we fly may still be the stars and bars But it’s over, which brings me to the revolution in Thomas Jefferson. In 1987,

he wrote a letter to William Stevenson, a New York lawmaker, a representative of the state of New York, United States Congress. And he he talked about, you know, the birth of the United States. He said, look, it’s been we’ve created a nation of 13 states.

that have been together for 11 years based upon a single act of rebellion. But he said, you know, you can’t expect the people to always be on the ball. Even during the rebellion, the people weren’t as informed as they should have been about many issues. And as a result,

when you have a people that are not actively engaged in the processes of governance, then the government will begin to behave in a tyrannical fashion. And then it may be time for the people to rise up again. The tree of liberty must be washed in the blood of patriots and tyrants, Thomas Jefferson said.

It is the manure of life. The United States has been around for 250 years. On July 4th, we’ll celebrate our 250th year of independence. But if Donald Trump gets away with what he has, this is literally the last year we can say we function as a constitutional republic. It is the end of the United States.

Then we, the people, have a choice to make. Do we become simply a Roman mob sitting in a coliseum waiting for the Emperor Caligula to appease whatever base desires we have through violence, through gluttony, through sex? Or do we act as the independent people we are, a people founded in the notion of the rule of law,

people who believe in justice, people who believe in a better way of life, people who will not stand. The actions of tyrants. Choice will be ours to make in the near future. I hope we don’t have to make it. I hope Alvin Hellerstein wins the Battle of New York. And I hope the constitutional republic is restored.

But if not, all bets are off. That’s been my rant. I’ll talk to you the next time a thought crosses my mind.

“I have never seen the US government arrive in a desert to plant life. They always arrive to destroy.”

Venezuela’s Acting President Delcy Rodríguez gave a master class on US sanctions policy in 2024

She connected it directly to Palestine: “The genocide against Palestine is an extension of the same policy—the destruction of humanity, exterminating peoples so that speculative capital survives.”

What she said:

The US controls SWIFT, the international financial messaging system. Every global transaction flows through it. One button excludes any country.

The hegemon uses unilateral coercive measures, so-called ‘sanctions’, as a means of extortion against countries that do not obey its instructions.

26,000+ unilateral sanctions exist worldwide. 31 countries sanctioned—representing 28% of world population and 72% of Earth’s territory.

96% of sanctions are concentrated on 10 countries. Mostly oil and energy producers essential for the development of humanity.

Venezuela lost access to 77% of its international correspondent banks “in one second”

99% drop in national income. $232 billion in lost oil production. $700 billion total economic damage—comparable to WWII bombing of Germany and France

. US State Department stated, 2018: “Our sanctions forced Venezuela to default… We are seeing total collapse. Our policy works.”

Citgo seized. $22 billion in assets frozen. Venezuelan gold stolen by Bank of England “because we don’t know who the government is”

?The US-appointed “president” of Venezuela’s Central Bank lives in Miami and runs a hamburger business. This is who they claimed should control Venezuela’s gold reserves. “International law does not govern. The only thing that governs is barbarism.”

BREAKING NEWS: SIX STEPS THE U.N. MUST TAKE RIGHT NOW [Jeffrey D. Sachs‘ speech to the UN Security Council on the US attack on Venezuela]

.

MR PRESIDENT, DISTINGUISHED MEMBERS of the Security Council, the issue before the council today is not the character of the government of Venezuela.

The issue is whether any member state by force, coercion, or economic strangulation has the right to determine Venezuela’s political future or to exercise control over its affairs.

This question goes directly to article 2, section 4 of the United Nations Charter, which prohibits the threat or use of force against the territorial integrity or political independence of any state.

The council MUST decide whether that prohibition is to be upheld or abandoned. Abandoning it would carry consequences of the gravest kind.

.

COVERT REGIME CHANGE

Let me offer some background.

Since 1947, the United States foreign policy has repeatedly employed force, covert action, and political manipulation to bring about regime change in other countries.

This is a matter of carefully documented historical record.

In her book, Covert Regime Change, political scientist Lindsey O’ Rourke documents 70 attempted US regime change operations between 1947 and 1989 alone.

These practices did not end with the Cold War. Since 1989, major United States’ regime change operations undertaken without authorization by the Security Council have included, among the most consequential:

Iraq 2003

Libya 2011

Syria beginning in 2011

Honduras 2009

Ukraine 2014 and

Venezuela from 2002 onward.

.

MODUS OPERANDI

The methods employed are well established and well documented.

They include:

open warfare

covert intelligence operations

instigation of unrest

support for armed groups

manipulation of mass and social media

bribery of military and civilian officials

targeted assassinations

false flag operations, and

economic warfare.

.

ILLEGAL MEASURES

These measures are illegal under the UN charter and they typically result in ongoing violence, lethal conflict, political instability, and deep suffering of the civilian population.

The recent US record with respect to Venezuela is also clear.

In April 2002, the US knew of and approved an attempted coup against the government.

In the 2010s, the United States funded civil society groups actively engaged in anti-government protests. When the government cracked down on the protest, the US followed with a series of sanctions.

In 2015, President Barack Obama declared Venezuela to be, and I quote, “an unusual and extraordinary threat to the national security and foreign policy of the United States”.

In 2017, at a dinner with Latin American leaders on the margin of the UN General Assembly, President Trump openly discussed the option of the US invading Venezuela to overthrow the government.

During 2017 to 2020, the United States imposed sweeping sanctions on the state oil company Pedesa. Oil production fell by 75% from 2016 to 2020 and the real GDP per capita declined by 62%.

The UN General Assembly has repeatedly voted overwhelmingly against such unilateral coercive measures. Under international law, only the Security Council has the authority to impose such measures.

On the 23rd of January 2019, the United States unilaterally recognized Mr. Juan Gaido as interim president and a few days later froze approximately $7 billion of Venezuelan sovereign assets held abroad and gave the designated authority over certain of these assets.

These actions form part of a continuous US regime change effort spanning more than two decades.

.

ONE YEAR, SEVEN COUNTRIES

In the past year, the United States has carried out bombing operations in seven countries, none of which were authorized by the UN Security Council and none of which were undertaken in lawful self-defense under the charter.

The targeted countries include Iran, Iraq, Nigeria, Somalia, Syria, Yemen, and now Venezuela.

In the past month, President Trump has issued direct threats against six UN member states, including Colombia, Denmark, Iran, Mexico, Nigeria, and of course, Venezuela.

Members of the council are not called upon to judge Nicholas Maduro. They are not called upon to assess whether the recent US attack and ongoing naval quarantine results in freedom or in subjugation.

Members of the council are called upon to defend international law and specifically the UN charter….

.

AFFIRM SIX ACTIONS

Given that we are in the nuclear age, failure cannot be repeated. Humanity would perish. There would be no third chance to fulfill its responsibilities under the charter.

The Security Council should immediately affirm the following actions.

The United States shall immediately cease and desist from all explicit and implicit threats or use force against Venezuela.

The United States shall terminate its naval quarantine and all related coercive military measures undertaken in the absence of authorization by the UN Security Council.

The United States shall immediately withdraw its military forces from within and along the perimeter of Venezuela, including intelligence, naval, air, and other forward deployed assets positioned for coercive purposes.

Venezuela shall adhere to the UN charter and to the human rights protected in the universal declaration of human rights.

  • The Secretary General, I recommend, should immediately appoint a special envoy mandated to engage relevant Venezuelan and international stakeholders and to report back to the Security Council within 14 days with recommendations consistent with the charter and the Security Council should remain urgently seized of this matter.

  • All member states should refrain from unilateral threats, coercive measures, or armed actions undertaken outside the authority of the UN Security Council.

.

WITHER INTO IRRELEVANCE

In closing, Mr. President and distinguished members of the council, peace and the survival of humanity depend on whether the United Nations Charter remains a living instrument of international law or is allowed to wither into irrelevance.

That is the choice before this council today.

.

Several things people are seeing now:

Maduro was kidnapped by the US military in a transnational operation

The US is threatening Mexico, Colombia, and Cuba

Several countries are showing a tendency towards nuclear self-defense. These all point to a core fact: The US is returning to “global intimidation-based unilateralism” rather than traditional hegemony.

Traditional Hegemony:

Maintaining order, controlling rules, managing conflict Trump-style Hegemony:

Destroying rules, using force, creating fear This will lead to a global outcome: Every country is asking: When will China intervene?

Because:

Russia’s own wars have been extremely costly.

Europe is a vassal system and cannot act independently.

Among the G20, only China can rival the US in terms of power.

China Now Faces a Strategic Crossroads

Route 1: Traditional Diplomacy — Non-Intervention

Advantages:

Avoids entanglement in direct conflicts

Maintains internal development and strategic focus

Denies the U.S. a justification to rally allies against China

Disadvantages:

Global fear of the U.S. will deepen

Developing countries may question China’s credibility as a stabilizer

The resulting power vacuum will be filled by U.S. coercion

China’s silence may be mistaken for weakness

This is the path China knows best, but the world may no longer allow it.

Route 2: Limited Security Commitment — The Quasi-Alliance Model

Without forming formal alliances, China signals that if countries like Venezuela, Iran, Pakistan, or Brazil are subjected to illegal U.S. military operations, it will offer economic, diplomatic, and intelligence support.

Think: the “ambiguous protection” the U.S. extended during early Cold War years.

Advantages:

Strengthens China’s position in the Global South

Discourages U.S. adventurism against weaker states

Raises the cost of unilateral U.S. action

Disadvantages:

Risk of being dragged into proxy wars

Fuels the “China threat” narrative

Requires a transformation of China’s diplomatic machinery

Route 3: Rewriting the International Order

This is what many nations quietly hope for—China stepping up as an architect of a post-hegemonic world.

Key elements:

Launching a high-level global initiative beyond the BRI

Establishing a multipolar security framework

Offering alternatives to biased international arbitration

Publicly opposing U.S. military abductions, extraterritorial arrests, and unilateral sanctions

Building a long-term anti-hegemony alignment bloc

Advantages:

Dozens of Global South countries will openly rally behind China

The deterrent aura of U.S. power is fading

China will be recognized as a true global power, not just an economic one

Disadvantages:

Essentially triggers Cold War 2.0

U.S. hostility will escalate dramatically

Demands tremendous economic, technological, and strategic capacity

This is the hardest path, and the one China hoped to delay. But delay may no longer be an option.

Conclusion: Trump’s doctrine of global intimidation is not just reshaping world politics, it’s forcing China to assume global leadership earlier than planned.

China’s original trajectory was: “Develop → Accumulate → Redevelop → Gradually influence the world.”

Trump’s trajectory is: “Destroy → Kidnap → Intimidate → Escalate.”

And now, many nations are asking themselves: “If it’s Venezuela today, will it be me tomorrow?”

This rising panic is transforming into pressure.

China has no intention of replacing the United States, but if the US only instigates wars, panic, and nuclear motivations, then the world will sooner or later force China to assume the responsibility of “order rebuilding.”

The most absurd thing is that those countries that once called China a “dictator” now hope that China will become a responsible empire.

Above all, China aims to avoid being thrust prematurely into a destabilized international environment in which smaller states resort to nuclear deterrence as their only guarantee of survival.

The presence of thousands of unexploded materials around schools and residential areas also pose a real threat to any attempts to resume education.

Trump is unhinged and dangerous. But there is international complicity –– because Australia, Canada, European governments have allowed this development. I hope that at least the Global Majority in Latin America, Africa and Asia will stand up for international law.

We are no longer in a constitutional order in the US but in a dictatorship. Both the House of Representatives and the Senate have failed the American people and bear responsibility for the crimes committed by Donald Trump, Marco Rubio, Pete Hegseth. We are NOT a democracy.

When will Europeans and others in the world understand that the US government is an international outlaw? US is not a country under law but a predator out to exploit the rest of the world in 19th century-style imperialism.

The international community must refrain from recognizing any decisions taken by the US concerning Venezuelan assets and resources.  It should also stop buying US F-16, F-35, Boeing etc

Slovak prime minister Robert Fico slammed the US for attacking Venezuela, branding the raid “the latest American oil adventure”. This follows the 2003 aggression on Iraq and the 2011 aggression on Libya. The international community shares responsibility for its inaction.

We are witnessing a civilizational collapse with the EU sanctioning Jacques Baud, a retired Swiss colonel and intelligence officer, for publishing books and articles expressing views on the Ukraine war contrary to those of the NATO leadership.

The woman in this photo is Cilia Flores, the wife of the President of Venezuela, who was brought to court in this manner by U.S. authorities and human rights defenders. Those who call on the U.S. to protect women’s rights should keep this image in mind. If the same had happened to Donald Trump’s wife, human rights activists would have reacted strongly across the world. ❌?￰゚ヌᄇ?￰゚ヌᄇ❌

Russia and the U.S. have early warning systems. Europe has none. They’re defenseless.

Our tactical nukes are 4x stronger than Hiroshima’s. We have more of them. Much more.

If war breaks outEurope will burn first.

From Russia’s perspective, the war began due to the NATO-backed coup in Kyiv in 2014 and efforts from the first day after the coup to transform what had been an overwhelmingly Russian-friendly country into a hostile, anti-Russian frontline state. Over the next 8 years, NATO ignored the Minsk peace agreement and instead used the time to entrench itself in Ukraine and build a powerful Ukrainian proxy army and intelligence services to weaken Russia as a strategic rival. Russia then invaded in 2022 with the key objective (by either military or diplomatic means) of ensuring that NATO and its intelligence agencies are dislodged from Ukraine. Territorial acquisitions are seen as a guarantor that these regions will never be used as a NATO frontline. To prevent the destruction of Ukraine and avoid a direct war that would likely escalate into a nuclear exchange, it is imperative to recognise the security concerns of Russia. Instead, the UK and France commit themselves to “build protected facilities for weapons and military equipment”in Ukraine after the war, which ensures that the war cannot end. It does not matter if NATO countries believe they are fighting for “democracy” and “freedom”; Russia sees this as an existential threat and will act accordingly. Ask yourself why these European leaders have sabotaged every peace initiative, boycotted diplomacy for almost 4 years, insists that deterrence is the only path to security, while smearing and censoring dissent. This is not to “stand to Ukraine”, but an effort to fight to the last Ukrainian.

Nael Barghouti spent 45 years behind Israeli bars, witnessing decades of Palestinian political struggle from inside prison walls.

In 2009, Guinness World Records named him the world’s longest-serving political prisoner, breaking the record previously held by another Palestinian detainee.

Inside prison, fellow inmates called him the “dean of Palestinian prisoners” for his guidance, courage, and unwavering moral influence.

Prison did not teach me – I taught prison what freedom is,” Barghouti said.

The will of a person who believes in their rights cannot be broken by bars, jailers, or walls. True freedom is living it, even behind prison walls.”
